The Eyesmith
Terms and Conditions for our Eyecare Plans (“Terms”).
These Terms apply to patients (“you”) of The Eyesmith (the trading name of EB Eyecare Limited, a company registered in England, number 14912479, whose registered office is Chester House, Lloyd Drive, Ellesemere Port, UK, CH65 9HQ) (“The Eyesmith”, “we”, “us” and “our”) who choose to enrol in one of our Eyecare Plans.
Services provided under our Eyecare Plans.
1.1. You are entitled to the following services and benefits under our Eyecare Plans, in return for payment of the monthly fees specified:
Enhanced Eyecare Plan
Annual eye examinations, including OCT, glaucoma testing, macular assessments and photography, as needed, and digital copies of images captured (on request)
Emergency consultations for eye concerns (see 1.3 below)
20% discount on spectacles (frames, lenses, sunglasses)
10% discount on over-the-counter products
The option to pay for your spectacles on an interest-free direct debit plan of 3 months
£7.50 per month per individual
£26 per month per household (entitling all individuals within one household to the services and benefits of our Enhanced Eyecare Plan)
Enhanced Eyecare Plus Plan
Annual eye examinations, including OCT, glaucoma testing, macular assessments and photography, as needed, and digital copies of images captured (on request)
Emergency consultations for eye concerns (see 1.3 below)
20% discount on spectacles (frames, lenses, sunglasses)
10% discount on over-the-counter products
The option to pay for your spectacles on an interest-free direct debit plan over 3 months
Contact lens measurement and fitting appointments and additional eye assessments (see 1.4 below)
Refit appointments to trial new lenses (see 1.4 below)
Dry eye assessments
10% discount on dry eye treatments
£11.50 per month per individual
£35.00 per month per household (entitling all individuals within one household to the services and benefits of our Enhanced Eyecare Plus Plan)
1.3. If you have an eye concern/emergency, every effort will be made to give you an appointment in an appropriate timescale based on the concern/emergency condition you are suffering from, however this will only be possible during our normal business hours. If we are unable to offer you an appointment or you are unable to contact us, you should seek immediate help at your local eye hospital if necessary.
1.4 Our Enhanced Eyecare Plus Plan includes contact lens checkups and trials of new contact lens products, based on clinical need (as determined by your optometrist). It does not include the supply of contact lenses themselves, although we are also able to offer this.
1.5 We may make changes to the services and benefits offered under our Eyecare Plans and to the amount charged. We will notify you about any changes to the amount charged by giving you 21 days’ written notice.
2. Fees and Direct Debits.
2.1. All fees must be paid by Direct Debit, monthly, on the 1st or 15th of the month (at your option).
2.2. Fees are non-refundable, other than during any cooling off period. In particular, you will not be entitled to any refund or repayment in respect of any services or benefits offered under an Eyecare Plan from which you do not benefit or which you do not use.
3. Renewal/Cancellation.
3.1 Your Eyecare Plan will automatically renew on a rolling basis.
3.2 We may cancel your Eyecare Plan by giving you written notice (email or post). If we cancel your Eyecare Plan, no further monies will be taken from you and no further services or benefits will be available or due to you.
3.3 You may cancel your Eyecare Plan by giving 14 days’ written notice (email or post). If you cancel your Eyecare Plan within 12 months of initial commencement, you will need to repay to us the value of all the services and benefits (e.g. discounts) you have benefitted from. No further services or benefits will be available or due to you.

5. Other Matters.
5.1. Neither party to these Terms shall be liable to the other or in breach of this agreement if either party is prevented, hindered or delayed in the performance of its obligations by any act of God, war, riot, postal strike, civil commotion, transport interruption, explosion, fire, radiation, accident, terrorism, government action, interruption in the supply of power, labour dispute, epidemic, illness, death or other circumstances beyond the control of the parties which prevents a party from, or hinders or delays a party in, performing its obligations under these Terms or any agreement.
5.2 These Terms are the entire agreement between the parties and supersede any representations, documents, negotiations or understandings, whether oral or written, made, carried out or entered into before the date of receipt of these Terms, except that this clause shall not exclude liability in respect of any fraudulent misrepresentation.
5.3 In the event that one or more of the provisions of these Terms is found to be unlawful, invalid or otherwise unenforceable, that / those provision(s) shall be deemed severed from the remainder of any agreement and/or these Terms, the remainder of any agreement and/or these Terms shall be valid and enforceable.
5.4 The Contracts (Rights of Third Parties) Act 1999 shall not apply to these Terms or any related agreement and no person who is not a party to these Terms/any such agreement shall be entitled to enforce any provisions of them pursuant to that Act.
5.4 These Terms are governed by, and are to be construed in accordance with, English law and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
